Regulations on Disciplinary Violation of International Students in LNU (Trial)

Chapter One General Rules

1. The following regulations are designed to maintain an orderly academic/living environment for students while they reside in China. These guidelines follow Ministry of Education and the LNU’s International Students’ Disciplinary Act, and incorporates actual events experienced previously by international students who were visiting our university. The rules are made in an effort to inform and to protect the students.

2. International students referred to these regulations are postgraduates and undergraduates as well as registered Chinese Language Students who have received official academic status at LNU. Students who are studying for a short term, or those who require refresher courses are protected under these regulations.

3. The university intends to respect the following principles while administering disciplinary actions:

① The situation at hand must be considered legal and rightful;

② The university must always base its disciplinary judgments on factual evidence, and ensure any action is always conducted fairly, and with the nature and severity of the offence borne firmly in mind;

③ The university should attempt to balance education and punishment when making disciplinary judgments.

4. Punishment types fall under five of the following categories:

① An initial warning;

② A serious warning;

③ A record of demerit;

④ Remaining in school, but placed under surveillance;

⑤ Expulsion.

5. International students who violate rules in conjunction with the following conditions will be subject to a disciplinary measure one level more severe:

① through drunken misconduct;

② through creating disturbance disregard of the advice of supervising personnel;

③ through acts of vengeance;

④ when harm or damage is done intentionally to a witness;

⑤ when a poor attitude is maintained following a breach of discipline;

⑥ through gang-related activity.

6. Mild actions will be taken for the following cases:

① Disciplinary offence that are not actually committed;

② During investigation, the offender truthfully tells the facts about the offence and shows deep remorse for the offence.

7. More lenient actions shall be taken for cases that fall into any of the following categories:

① Voluntarily informing the university department concerned about one’s own offence, or voluntarily providing facts about one’s own offence that are not yet known to the university department concerned during investigation;

② Voluntarily providing truthful facts about others’ disciplinary offence unknown to the university;

③ Voluntarily stopping misconduct or taking measures to mitigate the consequences of the offence;

④ Committing offences as a result of another’s threat or persuasion.

8. If a student is verified by legal procedures to have committed an offence when he/she was unable to identify or control his/her own behavior, he/she will not face disciplinary actions. But the students will be asked to be on leave of absence or withdraw from normal studies in accordance with relevant regulations on students’ status management. If a student has committed an offence when he/she was not able to totally identify or control his/her own behavior, he/she will receive mild or a lighter penalty, except for those who drinks in the case.

9. For students who are repeat offenders:

① Those who have been reprimanded twice by the university or three times by the school and whose penalty is circulated all over the university will be given a warning or serious warning;

② Those who continue to violate rules or regulations and are reprimanded by the university or by the school and whose penalty is circulated all over the university will be given a penalty one level more severe for each additional infraction.

 

Chapter Two Detailed Rules

10. Students who violate Chinese laws, decrees or regulations and are punished by the judicial or administrative department will incur the following penalties:

① Students who are put under surveillance or taken into custody will be immediately expelled from the university;

② Students who are found guilty of disturbing the peace:

A. Students who have received a warning or have been fined will receive disciplinary action in the form of a warning, serious warning, or a demerit on their record;

B. Detained students will be given a formal demerit, will be placed under surveillance and must remain on the university grounds. In some cases, students will be compelled to leave the university, depending upon the severity of the offence(s);

C. Students who are released from questioning and/or detention by judicial offices will either be allowed to remain in the university under surveillance or be expelled from the university.

11. Students who disturb the normal routine of university life or disturb the peace will incur the following disciplinary actions:

① Students who exhibit posters, publish illegal leaflets, establish illegal organizations, or publicly distribute printed materials without the university’s approval, will either receive a warning or other type of punishment. Students whose actions cause serious consequences will receive a demerit or worse punishment, depending on the offence;

② Students who disturb the peace by burning or scattering around materials or acting in a violent manner will receive a warning. According to the seriousness of the action, students may be forced to remain on campus or receive more serious punishment, depending upon the seriousness of the offence;

③ Students who instigate punishable activity, illegally assemble to cause public unrest, or disturb the peace on campus will be given a demerit or more serious punishment, depending upon the seriousness of the offence;

④ Students who intentionally post pornographic materials, vandalize by graffiti, or damage the university environment and, who do not change after education will be warned or punished according to the seriousness of the offence. Students who intentionally destroy important university notices and announcements will be warned or punished accordingly;

⑤ Students who impede university personnel or prevent them from performing official business, or students who violate university regulations will either be warned or punished accordingly.

12. Students who are absent from class without asking for leave will be given the following punishments: Students who are absent for a total of between 12 and 23 hours of class time will be issued a warning. Students who are absent from class for between 24 and 35 hours of class time will earn a serious warning, and those absent for between a total of 36 and 47 hours of class time will be issued a record of demerit. Absenteeism for between a total of 48 and 59 hours of class time will be issued a kept-on campus notice and placed under surveillance, absenteeism of more than 60 hours will result in expulsion.

13. Students who are found guilty of cheating on their examinations or in writing their thesis will be punished according to the following criteria:

① Students found guilty of cheating on their examinations will be confined to campus and placed under surveillance or receive more serious punishment according to the seriousness of the offence. Students who cheat repeatedly or are guilty of asking others to cheat for them, will face expulsion. Students who have others take exams in their place, or write exams for others, or who in any way organize cheating on examinations will be expelled. Students who use communication devices to cheat or engage in any form of cheating on exams will face expulsion from the university;

② Students found guilty of plagiarizing material for use in their writing assignments, course or graduation designs will be forced to remain on campus and placed under surveillance or, in more extreme cases, be expelled from the university.

14. The students who cause disorder to the construction of harmony on campuses or disrupt social order shall be subject to the following penalties based on the severity of their offences:

① For damaging public facilities, lawns, public sanitation or any other violations of the university's regulations on the management of public locations, the penalty shall range from warning to probation;

② For unauthorized use of electricity, fire, hazardous equipment or any other behavior that is likely to threaten public safety, the penalty shall range from warning to probation;

③ For deliberately hindering university staff from exercising their duties, the penalty shall range from serious warning to probation;

④ For causing disturbances, throwing and smashing objects on university premises or any other actions that severely disrupt others’ studies or lifestyle, the penalty shall range from serious warning to probation;

⑤ For causing disturbances after excessive drinking, the penalty shall range from warning to probation based on the severity of the offence;

⑥ For making public or university emergency calls for malicious purposes, the penalty shall range from warning to probation;

⑦ For making up and spreading rumors or fabricating information, making false statements, distorting facts and the like, the penalty shall range from warning to probation;

⑧ For taking objects prohibited by China’s law into the university, storing or using highly toxic, inflammable, explosive, corrosive, radioactive, contagious, bacteria/virus samples or any other objects prohibited by China’s law on campus without authorization, the penalty shall range from warning to probation;

⑨ For any violations of the university’s moral norms, the penalty shall range from warning to probation.

 

15. International students are prohibited from being employed full-time, running a business, or being engaged in other business while studying on campus. For violating this regulation, the penalty shall be imposed in accordance with the regulations concerned under China’s law.

16. Students who violate Internet administration regulations will incur the following penalties according to the seriousness of their cases:

① Students who create a disturbance in the university computer network should be given serious warning according to the severity of the offences.

A. Students who are found guilty of misappropriate use of another person’s IP address to access their email;Students who hack into government, company or institutional websites, or otherwise attack the Internet system;

B. Students who maliciously spread knowledge of internet system loopholes or incite others into hacking or attacking websites.

② Students who copy or distribute harmful or damaging information through the Internet that causes serious consequences will be confined to the campus and placed under surveillance, or given more serious punishment, as circumstances dictate. They will also be reported to the judicial department.

C. Students who are found guilty of disseminating obscene and/or pornographic material, information concerning illegal gambling, violence, murder, or horror, and/or instigating others to commit similar crimes;

D. Students who are found guilty of spreading slanderous rumors or personal attacks which have an adverse effect upon another person’s honor;

E. Students who are found guilty of creating, copying, distributing and/or spreading illegal information;

F. Students who misappropriate other people’s names and release information that results in serious consequences will earn a demerit from the university, or more serious punishment depending on the circumstances.

17. Students whose actions infringe upon another person’s rights will be held responsible for paying compensation to the victim(s), (medical expenses, nutrition costs, loss of expenses, etc) and may face additional punishment according to the seriousness of the offense:

① Students who instigate rumors, slander, insults, make false allegations, or those who swindle and/or abduct others will be given a serious warning or discipline, depending upon the circumstances. If this behavior causes more serious consequences, they will be confined to the campus and placed under surveillance, or earn more serious punishment, depending upon the circumstances.

② For causing disturbances, assault and gang fighting:

A. Students who engage in fighting will be warned. If their actions cause serious consequences, they will earn a demerit or punishment, depending on the circumstances; For plotting, inciting assault or gang fighting, if it produces no consequence, the penalty shall be serious warning; if it produces consequences, the penalty shall be demerit or probation according to the severity of the offence; if the consequence is severe, the penalty shall be expulsion; for students who incite fighting, a more severe penalty shall be imposed; for the student who asks the people off campus to fight, a severe penalty shall be imposed;

B. For assaulting others without causing injuries, the penalty shall be serious warning; for assaults causing slight injuries, probation will be imposed; for those causing minor injuries, probation or expulsion; for those causing serious injuries will result in expulsion, and will be transferred to a court of law;

C. For using weapons in assault or gang fighting, the penalty shall be probation or expulsion according to the severity of the offence;

D. For students who are partial to one side in assaults under the pretext of persuasion to not fight, and what he/she does makes the assault worse, produces consequences, the penalty shall be serious warning or demerit; if the consequence is serious, the penalty shall be probation or expulsion;

E. For interrupting other people’s normal lifestyle by any means, the penalty shall be warning or serious warning; for threatening other people’ s life by any means, the penalty shall range from demerit to expulsion;

F. or providing false or misleading testimony as a witness of an offence to cause complications for the


investigation, the penalty shall be serious warning or demerit;

G. For providing others with weapons in an assault or fighting, if no injury is caused, the penalty shall be serious warning or demerit; if light or minor injury is caused, demerit or probation; if serious injury is caused, probation or expulsion;

H. For provoking others through verbal insults or other ways, the penalty shall be serious warning or demerit according to the severity of the offence.

18. Students who violate university rules and/or regulations or those who hurt or disturb others with speech or otherwise cause trouble with serious consequences will incur the following punishments according to the seriousness of the case.

① Students who want to see a fight but do not take part themselves will receive a warning from the university;

② Students who take part in a fight but do not injure others will be warned by the university;

③ Students who inflict minor wounds on others will receive a demerit or be confined to the campus and placed under surveillance;

④ Students who seriously injure others will be forced to leave the university, or be formally expelled;

⑤ Students who instigate or cause trouble will be forced to leave the university or be formally expelled.

19. Students who steal, extort, swindle, embezzle, falsify a claim or take possession of public, collective or private property will be punished in the following ways, and forced to return pilfered property and/or to compensate the owners for any losses.

① For the property worth RMB 300 Yuan or less, the penalty shall be warning;

② For the property worth from RMB 301 yuan~500 Yuan, the penalty shall be serious warning;

③ For the property worth from RMB 501 yuan~1,500 Yuan, the penalty shall be demerit or probation depending on the severity of the offence;

④ For the property worth RMB 1,501 Yuan or more, the penalty shall be expulsion depending on the severity of the offence;

⑤ For those who didn’t succeed in stealing but whose action is proved to be stealing by the Security Office of LNU or the Police Department, the penalty shall range from warning to expulsion, depending on the severity of the offence;

⑥ For those who did not steal directly but provided information, assistance or tools to the perpetrator, the penalty shall range from warning to expulsion, depending on the severity of the offence;

⑦ For those who provided information, assistance or tools for disciplinary offences, those who covered up facts of the perpetrator, or concealed stolen goods for others, the penalty shall range from serious warning to probation;

⑧ For those who misuse others’ Student Card (or ID Card) to falsely claim other’s posting property, or steal other’s bank card, the property shall be returned to the owner. In addition to that, the penalty shall range from demerit to probation.

20. Students who take part in or organize gambling or take banned drugs will be forced to leave the university immediately.

21. Students whose alcohol abuse cause serious consequences will be liable for compensation and/or the following punishments:

① Students who abuse alcohol and pick fights and/or make trouble will receive a warning from the university;

② If a student has a problem with alcohol abuse and err, but they try to correct their bad behavior, will receive a demerit, be confined to campus, and be placed under surveillance;

③ Students who have problems with alcohol abuse and refuse to correct their mistakes will be compelled to leave the campus or be expelled.

22. Students whose illegal behavior infringes upon the university’s rules will receive the following punishment which includes the confiscation of any illegal income and/or the payment of compensation:

① Students who engage in illegal trade will receive a punishment that is more serious than a warning;

② Students who employ deception to gain a scholarship from the university will be warned;

③ Students who alter course grades, forge credentials or certificates, or falsify signatures or official seals will be either confined to campus and placed under surveillance or be more severely punished;

④ Students who intentionally and repeatedly damage public property and cause serious consequences will be compelled to leave the university, or be expelled;

⑤ Students who fail to pay their tuition and accommodation fees for more than one semester will be expelled from the university.

23. Students who violate fire-safety regulations and/or cause a fire will receive the following penalties based on the seriousness of the offence:

① Students who have improper behavior but did not cause significant losses will be warned by the university;

② Students whose improper behavior caused heavy losses will be given a demerit, be confined to the campus and placed under surveillance, or be compelled to leave the university;

③ Students who are proven arsonists and whose actions have caused heavy losses will be expelled from the university.

24. Students who commit a moral transgression will be subjected to the following penalties according to the seriousness of the offences:

① Students who commit a moral transgression will be criticized by the university. Then, if they remain incorrigible despite repeated admonition, they will receive a warning from the university;

② Students who ignore or knowingly violate university rules and regulations, they will receive a warning, or receive punishment according to the seriousness of their offence;

③ Students who open other’s mail or packages without permission, or damage other people’s property will receive punishment more severe than just a warning from the university;

④ Students who intimidate, induce, threaten, demand or force other students by any means to do something against their will which results in serious consequences, may receive punishment more serious than a warning from the university, depending upon the circumstances;

⑤ Students who force others to go on dates that result in serious consequences will be given a warning;

⑥ Students who follow, harass or tease others and disturb their university lifestyle will be punished more severely than simply being warned, and according to the seriousness of the offence;

⑦ Students who accommodate members of the opposite sex or stay overnight in an opposite sex dormitory will be punished more seriously than being confined to the campus and being placed under surveillance. Male and female students who live together will be forced to leave the university. Students who engage in voyeurism or cause disturbance to others will earn a demerit from the university, or more serious punishment depending upon the seriousness of the offence. Students who refuse to correct their behavior will be compelled to leave, or will be expelled from the university;

⑧ For the students who have non-marital sex that leads to serious consequences, the penalty shall be demerit or probation; For having unlawful sexual acts, the penalty shall range from demerit to expulsion;

⑨ Students who view, store, manufacture, distribute, duplicate or sell pornographic materials and refuse to correct their behavior will be warned, or be given more serious punishment according to the offence;

⑩ Students who scribble obscenities or draw lewd pictures around the university but refuse to correct their behavior will be given a demerit, or incur more serious punishment depending on the offence;

⑪ Students who humiliate women or have illegal sex will be confined to the campus and placed under surveillance, compelled to leave, or be expelled from the university, depending on the seriousness of the offence.

25. Students who violate dormitory regulations or management will incur the following punishments according to the seriousness of the offences:

① Students who accommodate others in their room without permission will either be warned or incur more serious punishment, depending upon circumstances;

② Students who always return to their dormitory late, fail to return, disturb other students, make loud noise, play loud music, dance, etc and refuse to correct their behavior will be warned by the university;

③ Students who engage in hooligan behavior in their dormitory, disturb the peace, or offer prostitution services will be immediately expelled;

④ For violation of dormitory regulations, staying overnight in the dormitory of the opposite sex, letting outsiders or people of the opposite sex hang around/linger or stay overnight in the dormitory, the penalty shall range from warning to serious warning. For a student who does not return to his/her dormitory after 23: 30 without permission from the International Affairs Office five nights or less, the penalty shall be warning; six nights to fifteen nights, the penalty shall be serious warming or demerit; sixteen nights or more, the penalty shall be probation.

26. For drug abuse, the penalty shall be probation or expulsion depending on the severity of the offence.

27. For violating, impairing other’s legitimate interest and personal safety; doing harm to the interest of national or collective values:

① For unauthorized use of the identities of organizations or other individuals for personal interest:

A. For unauthorized use of the identities of organizations or other individuals for ones personal interest, the penalty shall range between serious warning and probation in addition to compensation for the losses;

B. For unauthorized use of others identities to claim their money or property, the penalty of demerit or probation shall be imposed in addition to the return of the money or property that has been claimed.

② For forging and selling certificates, seals and supporting documents or materials, or using other illegitimate methods for ones personal interest, the penalty shall be serious warning or demerit; for severe offences, probation or expulsion;

③ For maliciously harassing, intimidating, threatening others, the penalty shall range from serious warning to probation;

④ For malicious insults, defamation, framing or false accusations aimed at damaging other people’s reputations, the penalty shall range from serious warning to probation;

⑤ For concealing, intercepting, destroying or opening other’s letters or telegrams without authorization, the penalty shall range from serious warning to probation;

⑥ For those who expose China’s state secrets or LNU’s scientific or technological achievements or LNU’s technological secrets will receive the penalty ranging from demerit to expulsion, depending on the case.

28. Dishonorable academic behaviors shall be punished in accordance with the following rules: for slight violation of the research norm, the penalty to be imposed shall be serious warning; for minor violations, demerit or probation; for serious violations, expulsion.

29. The duration of probation is six months or a year. A student’s probation may be removed when the probation period is over, and he/she shows significant improvement during the probation; the student’s probation may be cancelled ahead of schedule if he/she performs extremely well during the probation. If a student on probation continues to violate the university regulations or commits other offences, he/she shall be expelled. If a student is going to graduate in less than six months before graduation, a penalty of demerit will be imposed on him/her instead of probation, even though the latter is more appropriate for the offence. Such graduating students shall not be granted diplomas, but a Course of Completion Certificate shall be given to them.

 

 Chapter Three Administrative Authority for Disciplinary Actions and Relevant Procedures

30. Generally, if a student commits a disciplinary offence, the school/ college he/she is affiliated to shall be in charge of admonishing and educating him/her and proposing relevant punitive actions. Such Proposals involving undergraduate students shall be submitted to the Students Affair Office for verification. For violations of the “Law of the People's Republic of China on Public Security Administration Punishments” or China’s criminal laws, the University’s Security Department shall be responsible for contacting the public security and judicial organizations, assisting and cooperating with them to ascertain facts, as well as filling out the Material Transference Form and passing the results of the investigation and procedures from public security and judicial organizations on to the Students Affair Office; Violations of education or examination regulations involving undergraduate students shall be handled by the Academic Affairs Office, which will work together with the school/department that the students are affiliated in verifying the facts and then make proposals for disciplinary actions. Violations of dormitory rules shall be handled by the University Dormitory Management Centre or Office of International Exchange and Cooperation, which shall verify the facts and make proposals for disciplinary actions. Such proposals shall be reviewed and approved by the Students Affair Office. In special cases, the Students Affair Office shall propose disciplinary actions directly.

31. For disciplinary offences that involve students from different schools/departments, Office of International Exchange and Cooperation shall assemble discussions with heads of the schools/departments concerned for proposals to deal with the offences in accordance with the regulations of this document. Based on the proposals, the schools/departments shall submit suggestions of punitive actions following the regulated procedures.

32. The decision on sanctions against international students shall be handled to Office of International Exchange and Cooperationthe Department of International Exchange and Cooperation of the Ministry of Education, the Department of Education of Guangdong Province and the Units of Exit-Entry Administration of Zhanjiang Municiple Public Security Bureau by the International Office. The relevant embassies (consulates) shall receive a copy and the parents or guardians of the students will be notified..

33. The degree certificate will not be awarded to those who have made serious mistakes and received the above points.

34. International students who are expelled will be immediately deregistered and their rights and obligations will be rescinded from LNU from the day the expulsion takes effect. Zhanjiang Public Security Bureau will cancel the international student’s residency permits. International students must leave the school within two weeks from when they receive the documents imposing these actions. Any expelled students who are unreasonable, and do not leave the campus, LNU and the Public Security Bureau will take coercive measures to force international students to leave school before the deadline.

35. The documents for imposing the actions shall be in triplicate, one for the student, one for the school/department that the student is affiliated to, and the other for the International Office files. The student must sign the delivery notice upon receiving the document. Refusal to sign it shall be recorded on file by the document delivery personnel. The school/department that the student is affiliated to shall give an appropriate admonitory education to the student after receiving the document. If the document cannot reach the student concerned, the university shall publicize it as a substitute for delivery.

36. Actions which are deemed punishable but are not listed in these regulations will be handled in conjunction with these given regulations.

37. If the students disagree with the penalties, they may make an appeal to the university. The appeal procedure is in accordance with the regulations concerned at LNU.

 

Chapter Four Supplementary Provisions

38. The price of commodities related to disciplinary offences for compensation shall be in accordance with the price when the commodities were bought.

39. These regulations document shall take effect from their date of issue; where the right of interpreting the details belongs exclusively to Office of International Exchange and Cooperation of LNU.
